Terms of Service

These Terms of Service ("Terms") govern your access to and use of Instaroom AI, including our website, mobile application, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

The Service is operated by Xuan Anh Nguyen, sole trader (OSVČ), Stará Stodůlecká 2, 158 00 Prague, Czech Republic.

You may use the Service only if you are legally allowed to do so under applicable law. The Service is not intended for children.

If you create an account or use the Service on behalf of another person or organization, you represent that you have authority to do so.

Instaroom AI provides AI-assisted image processing and visual concept generation for renovation, interior design, exterior design, architecture, and related design use cases.

The Service may allow you to upload images and submit prompts or instructions in order to receive generated outputs.

You may need to create an account to use some or all features of the Service. You agree to provide accurate information and keep your login credentials secure.

You are responsible for activity that occurs under your account unless caused by our failure to take reasonable security measures.

Certain features of the Service require a paid subscription.

Instaroom AI currently offers subscription billing cycles that may include:

• 3-day trial, where offered
• Weekly subscription
• Monthly subscription
• Yearly subscription

The exact pricing, currency, and offer terms presented at the time of purchase will apply.

If you start a free trial, your subscription may automatically convert into a paid subscription unless you cancel before the end of the trial period.

Subscriptions automatically renew unless canceled before the renewal date.

Billing, renewals, and cancellations are generally handled through the app store or platform through which you purchased the subscription. You can manage or cancel your subscription in your relevant app store account settings.

Except where required by applicable law or the rules of the platform through which you purchased the subscription, subscription fees are generally non-refundable once charged.

If you believe you are entitled to a refund under applicable law or platform policy, you should use the refund procedures of the relevant app store or contact support at instaroom.team@gmail.com.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

"User Content" means any content you submit, upload, input, or otherwise provide through the Service, including photos, images, prompts, and instructions.

You retain ownership of your User Content.

However, you grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display your User Content solely as necessary to:

• operate and provide the Service;
• generate outputs requested by you;
• maintain account functionality and storage;
• troubleshoot, secure, and improve the reliability of the Service; and
• comply with legal obligations.

This license ends when your content is deleted from the Service, except to the extent retention is required for backups, legal compliance, dispute resolution, or security purposes.

The Service may generate images or other output based on your inputs.

As between you and Instaroom AI, and to the extent permitted by applicable law and third-party provider terms, we assign to you any rights we may have in the generated output created specifically for your request.

You are responsible for reviewing generated output before relying on it, sharing it, publishing it, or using it in commercial or personal projects.

We do not guarantee that generated output is unique, non-infringing, accurate, safe, buildable, lawful, or fit for any particular purpose.

You agree not to use the Service to upload, generate, request, or distribute content that:

• is illegal, fraudulent, or deceptive;
• infringes intellectual property, privacy, publicity, or other rights of others;
• contains sexual content that is prohibited by law or by our content standards;
• involves child sexual abuse material, sexual content involving minors, or any exploitative content involving minors;
• promotes violence, dangerous activity, self-harm, or other harmful conduct;
• is hateful, abusive, or harassing;
• contains malware, malicious code, or attempts to interfere with the Service;
• violates any applicable law or regulation.

You also agree not to misuse the Service, including by attempting to reverse engineer the Service, bypass limits, scrape the Service without authorization, interfere with other users, or use the Service in a way that creates security or legal risk.

Instaroom AI is intended for inspiration, concept generation, and visual ideation.

The Service does not provide architectural, engineering, construction, structural, legal, zoning, safety, fire-code, or professional design advice.

Generated outputs may be inaccurate, incomplete, unrealistic, or unsuitable for real-world implementation. You should consult qualified professionals before making construction, renovation, safety, or purchasing decisions.

The Service may rely on third-party providers and platforms, including analytics, authentication, cloud infrastructure, AI providers, subscription tools, and app stores. Your use of certain third-party services may also be subject to their terms and policies.

We are not responsible for third-party services except as required by law.

The Service itself, including its software, branding, design, text, graphics, interfaces, and other non-user content, is owned by or licensed to Instaroom AI and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.

We may suspend or terminate your access to the Service, with or without notice, if:

• you violate these Terms;
• your use creates legal, safety, abuse, or security risk;
• we are required to do so by law; or
• we discontinue the Service or a relevant feature.

You may stop using the Service at any time.

You may also delete your account through Settings > Delete account.

Termination does not affect provisions that by their nature should survive termination, including provisions relating to payments already due, intellectual property, disclaimers, limitation of liability, and dispute-related terms.

We may modify, update, suspend, or discontinue all or part of the Service at any time. We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with all devices.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

We disclaim, to the maximum extent permitted by law, implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

To the maximum extent permitted by law, Instaroom AI and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to the Service.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

To the extent permitted by law, you agree to indemnify and hold harmless Instaroom AI and its operator from claims, losses, liabilities, and expenses arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the Czech Republic, excluding conflict-of-laws rules.

Any disputes arising out of or in connection with these Terms or the Service will be submitted to the competent courts of the Czech Republic, unless applicable consumer law provides otherwise.

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, website, or other reasonable means. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
